Terms of service
The agreement between your school and us, in plain words.

1. Who agrees with whom
These terms apply between Amber IT Solutions d.o.o., Split, Croatia (“we”), and the school, company or other organisation that opens an account (“you”). NGPT is a service for organisations, not for consumers. By creating an account you confirm that you may act for your organisation.
2. The service
NGPT lets you send online language placement tests to your candidates and read their results. A result is an estimate of a candidate’s level for the purpose of placing them in a course. It is not a certificate or a qualification, and it should not be the only basis for a decision with serious consequences for a person.
3. Your account
Keep your sign-in details and your API key to yourself, and tell us at once if you think someone else has them. You are responsible for what is done through your account.
4. Tests and price
- Tests are bought in advance. One test lets one candidate take one test in one language.
- The price is €1.99 per test, excluding VAT, with a minimum purchase of 10 tests. The price that applies is the one shown when you buy; a change of price does not affect tests already bought.
- A test is held when you send an invitation and counted as used when the candidate starts. If you withdraw the invitation, or it is not used within 30 days, the test returns to your balance.
- Payment is by card through Stripe, which sends a receipt. We send an invoice for each purchase by e-mail.
- If something has gone wrong with a purchase, write to us and we will put it right.
5. Free trial
We may add free tests to an account so that a school can try the service. They work like bought tests, cannot be exchanged for money, and create no obligation to buy.
6. Your candidates’ data
You decide which candidates to test and remain responsible for their data. You confirm that you are entitled to give us their details and to send them an invitation. We process candidates’ data only to provide the service to you, keep it confidential and secure, use only sub-processors bound to the same duties (the current list is available on request), help you to answer requests from candidates, and delete the personal details of a candidate when you remove them, and of all your candidates when you close your account and ask us to. We use answers, without names, to measure and improve the questions. If your organisation needs a separate data-processing agreement, ask us for one.
7. Fair use
Do not copy, publish or collect the test questions, try to obtain answers by technical means, resell access without our agreement, or use the service to send messages to people who have nothing to do with a placement. We may suspend an account that puts the service or other schools at risk.
8. Our content and yours
The questions, the software and the NGPT name and logo belong to us or to our partners. Your logo, your texts and your candidates’ data remain yours; you allow us to use them to provide the service to you.
9. Availability and liability
We work to keep the service available and accurate, but we do not promise that it will never be interrupted or that every result will match a teacher’s judgement. To the extent the law allows, our liability to you in any year is limited to the amount you paid us in that year, and we are not liable for indirect loss. Nothing here limits liability that cannot be limited by law.
10. Ending
You can stop using NGPT at any time and ask us to close your account. We may end the agreement with thirty days’ notice, or at once after a serious breach of these terms.
11. Changes, law and contact
If we change these terms in a way that matters, we tell account holders by e-mail before the change takes effect. These terms are governed by the law of the Republic of Croatia, and disputes go to the competent court in Split. Questions: finances@amber-it.co.
